Legal Brief: Business Succession Planning Can Save Your Company From the Unexpected

If you are a small business owner, you may have already given some thought to long-term business succession planning. But what if something happens to you tomorrow? Is your business protected?

An illness or accident that causes you to be suddenly absent from your business can create havoc if there are no plans in place for this possibility.

There are a number of options that can help you ensure your business runs smoothly in the event you become incapacitated:

Guardianship – you can appoint a guardian to assume your business responsibilities.

Power of Attorney – executing a power of attorney appoints someone as your agent to take over your business affairs. You can decide on the scope of their authority as well as the circumstances under which they would take over.

Trust – by placing your business in a trust, you are able to name a successor trustee to manage the assets of the trust (the business) in your absence. A business trust can also allow you to specify how the assets of the company are distributed upon your death.

Happy and Healthy to 102: Lessons for Living Longer from the Women Who Have Lived the Longest

You Can Eat Your Way to a Long Life

“What do the Peruvian, Scandinavian, Japanese and the Mediterranean women know what American women don’t? It’s to eat your way to a long life…yes we said eat!” www.HomecareAssistance.com

Portion control – Farm Fresh Foods – Reduce Stress – Eat Foods with Omega-3 Fatty Acids

These foods may even ward off the chances of developing depression, obesity or cancer. We have heard these good tips. But we rarely talk about the locations where these lifestyles prevail.

The Blue Zones

Blue Zones are areas where people traditionally lived healthier and more active lifestyles and many times live to ages 100 and older. Cold regions also have the lower rates of heart disease, depression and certain cancers, compared to those who live in warmer regions. Studying these cultures and their lifestyle habits can help Americans and others adopt healthier eating habits and implement them into their daily lives.

The goal is to identify common threads in lifestyles, diet, outlook and stress-coping mechanisms found in the world’s oldest and healthiest people. Studies continue on defining and developing new communities for senior care and home care that function like Blue Zones.

Okinawa, Japan

Okinawans restrict the amount they eat before every meal by saying “hari hachi bu” which is a phrase that means eat until you are 80% full. It takes 20 minutes for your stomach to tell your brain it is full, so give it the chance.

Life for the people revolves around their gardens. Time tending herbs and vegetables provide foods with high levels of anti-oxidants and anti-inflammatory properties. Being out in the garden provides exposure to the sun for that daily dose of vitamin-D.

Maintaining a positive outlook on life helps. Living for “ikagi” — a reason for waking up in the morning is a daily pattern. Groups of “moais” or lifelong friends who act as social, emotional and financial support networks are another successful social secret.

The important thing to remember is that it’s not about a complete lifestyle change, but more how small changes to one’s lifestyle habits can have significant benefits to one’s health and happiness

Nicoya, Costa Rica

Have a “plan de vida” or reason to live. Like the Okinawans, this often results in centenarians with an active lifestyle.

Faith plays a strong role in their lifestyle, relinquishing control of their life to God.

Third, colorful fruits and gardens with rice, beans and corn are staples.

Ikaria, Greece

Fruit-rich Mediterranean diets include vegetables, whole grains and a little fish. One key feature is wild greens, many of which have ten times the level of antioxidants in green tea or red wine!

Regular herbal tea consumption is common, and can act as a mild diuretic, prescribed by doctors to lower blood pressure.
People who nap at least five times a week for half an hour have 35% reduced chance of cardiovascular disease. Stress hormones also decrease when you’re napping, so regular naps are considered wise.

Make walking part of your daily routine. The hilly land lends itself well to burning calories so the Ikarians exercise without even thinking about it.

Are there some useful tips here?

Think about these patterns. Is there anything you can take from here to affect changes in your own life. There is more research on both the patterns of those who live in the “blue” and the new communities that are springing up around the world based on these ideas.

For the elderly here, in senior home care in North Carolina, the Homecare Assistance folks have built their “Balanced CareTM” philosophy around these same lessons learned and their caregivers are trained to assist your elderly loved ones to try out some of these best practices.

Where Do You See Yourself 10 Years From Now?

Where Do You See Yourself 10 Years From Now?

Don’t be like most people, living from paycheck to paycheck with the mere goal of getting to the end of the week.

Be bold! Plot out a strategy that will target your ideal “life story.”

Know what you want. Believe in yourself. Then focus on the specific targets you have to hit to get where you want to go — in the time you have.

Take the Challenge:  Convert Dreams Into Hard Targets with Specific Milestones.

  • Be REALISTIC! Where do you want to be 10 years from now? Can you see the milestones?
  • Be PROACTIVE! How would you most like to be remembered? Don’t be afraid… write it down right here… right now!
  • Be EXPLICIT! When, today, can you find the time to define the kind of future you want? Do you have a calendar for 2013?

You’ll never make a dream real until you have something specific to aim at. There is no way you can plan for — to say nothing of work toward — a “better life.” You can, however, stipulate a list of conditions that would define a better life. Each of those items can then be made into a precise target you can aim for, and immediately begin to work towards. So, dream your dreams, then identify specific examples in the real world that best represent the desired qualities of your dream. Once you do this, you’ll be well on your way to creating that “better life” you desire.

Think about it. How well and how often do you actually DO Set Goals?

“I make all my dreams real by first identifying and then focusing on specific, tangible targets for what I want.”

A high commitment suggests you have the power to be both a dreamer and a doer. You have the faith that you can make things happen if you want them badly enough. This gives you the confidence to go beyond wishful thinking, and identify exactly what you want in real-world terms. With a specific target in sight, you are then able to map a course of action to the desired destination. Once a goal is identified, you find it easy to commit to what it takes — because time and effort are spent on reaching tangible targets — rather than idly fantasizing about “someday” dreams.

I had a dream….I now live it and so can you.

Take action today!

Testimony from Salon Owner on Nerium International

Testimony From Salon owner…

Any of my friends own a salon or small business? Here is an AWESOME open letter to you from my friend Ashley, who owns a salon in Wisconsin. Check this out to see how YOU can be making REAL money by being a Brand Partner with Nerium International…

I have had many people ask me to share my experience with Nerium. Many of them are not on my team, so I don’t benefit at all from this. I believe in Nerium so much that I wanted to share with you.

I own a very successful commission salon. Like many other salons, I get products weekly on my desk to try. I didn’t think that I was going to be interested in Nerium. I didn’t think the profit margin was enough with it costing me $ 80 per bottle. I already have a skin care line that I carry and really like. I took it home to try because it was a very loyal client of mine that was promoting it. I brought it home and after the second night I knew that I had to invest in it. If you have used it, you know what I mean!

I went in at the $ 500 package and actually sold out the first day! Since getting Nerium in, my biggest issue has been keeping it on the shelf! We play the video of the before and after pictures on our televisions and it sells itself. I was skeptical at first about the business set up. What I have found out is I LOVE it. All my employees saw it flying off the shelf and had to get involved. I signed them all up under me. We have been selling it at such a rapid pace, that I qualified for an Ipad the first month. I opted out of that to get 7 bottles of Nerium for FREE and sold out with a PROFIT of $ 770. I don’t know about you, but none of my other companies give me free product! I think so far, I have earned 12 FREE bottles that I have made a PROFIT of $ 1,320. (Those were all free product and my investment was $ 0)

Being in the industry, I have a ton of salon connections and I am working on getting all them under me as well. I will then make commissions on everything they sell. I have never used a product like it. They offer a 30 day money back guarantee, so your clients feel comfortable purchasing. I literally don’t even have to sell, they see the photos and want it. I have sold over 45 bottles in less than 2 months and not had any returned. I have only had people continue to purchase. I set clients up on an auto-ship, I profit $ 15 per auto-ship and for every 3 I have signed up, I get a free bottle.

Nerium suggests you do “Real Results Parties”. I have not had to do 1. Everyday in my chair,it is like having a real results party. People are coming to us for beauty advice. When they are in our chair, they are looking to spend money and feel better about themselves. I feel that I would be doing a dis-service for any of my clients that don’t know about Nerium. If they don’t hear about it from you, they will hear about it somewhere. I like to be the one to profit from it and help them.

As I am sitting here right now, I am sold out of product again! That is a good problem to have. Yesterday, I left the salon and had 5 left. I thought I would have had enough this week, but I was wrong! We sold 5 yesterday and I will be ordering today.

I have had a lot of people say to me “You must be in a really big area”. The answer is no. I live in a town of 1,500 people. I have 6 stylists at my salon. I have worked very hard for the reputation that we have earned in our community. I could never bring in a product that didn’t work. I wouldn’t risk my reputation on it. In the end, you need to decide what is right for your salon. If you decide against it, I feel it is your clients loss. I guarantee you this, they will find it somewhere and hopefully it’s not the salon down the street that decides to have it. We all know that once a client is in another salons door, you risk them becoming their client.

I promise if you decide to invest in Nerium and become part of the team, you will not regret it.

Experts Share: How To Bounce Back From Failure!

Have you ever observed and wondered how some people seem to bounce back from any type of setback? How do they do it? How are they so resilient?

Ever since I recently moved back to North Carolina, I have been truly amazed at the incredible entrepreneurs who I have met and collaborated with professionally. These folks have come from a variety of industry backgrounds including the FBI, pulpit, pharma, sales training, personal development, coaching, business development, and many others.

As I was considering the content for this article, I wanted to get these individuals’ perspective on ‘how’ they have become so successful and how they have successfully persisted through failure and setbacks. Their responses, as you will read, are profound and wise.

Whereas others might have given up when obstacles seemed too difficult for breakthrough, the individuals you will read about below knew failure was just part of the success equation. They actually associated failure as a requirement for success. Additionally, by taking risk and learning from such failure, they bounced back each and every time and accomplished even more.

Lin Jordan has an ‘impressive-yet-classified’ background from the FBI and now enjoys connecting and supporting business entrepreneurs. He’s a pay-it-forward gentleman that I deeply respect. About failure, Lin believes “failure is a state of mind that is chosen rather than assigned. If you must, define failure as a temporary detour leading to success.” Lin finds the lyrics to Sarah McLachlan’s song Just Another Ordinary Miracle Todayto be a great motivational resource:

When you wake up everyday
Please don’t throw your dreams away
Hold them close to your heart
Cause we are all a part of the ordinary miracle”
~ Sarah McLachlan

Another mentor and friend having an incredible perspective on leadership and failure is Rich Gorman, owner of the renowned Sandler Training in Raleigh North Carolina. In 1990, Rich remembers reading a book by Robert Schuler titled ‘Success Is Never Ending, Failure Is Never Final’. For him, the book was life changing and put him on a path of personal growth that still continues today. Through that journey Rich realized that “failure is a prerequisite for sustainable success. Everyone fails. We can choose to look at failure as a negative experience, or we can choose to look at it as a learning experience with lessons to guide us on what needs to be changed in order to achieve our desired result.”

Rich continued, “the ability to learn from our failures is what allows the top performer to move forward and grow. If, on the other hand, we only see our failures as a reflection of our limitations, we will never use them as leverage to move forward and improve future performance. At Sandler, we recognize failure as a positive experience that gives us freedom to try new things, to be creative, and to move beyond our comfort zone.”

When I asked Rich about how he helps people move from a mindset of feeling like a failure to accepting failure for success, he replied with the following thoughts. “Accepting this concept intellectually is easy. However, dealing with failure emotionally is quite difficult. The ability to positively deal with failure requires the ability to separate your role performance from your self-esteem and your self-worth. People with a healthy self-esteem are able to more easily grow as a result of failure. If dealing with failure is difficult for a person, we typically work to bolster self-esteem. That process takes work but is certainly manageable.”

Incredible perspective from Rich – wise, very wise. His Sandler Training philosophy is spot on.

Becky Sansbury is a former chaplain and has an amazingly calm-yet-enthusiastic persona. She is an expert in adapting to crisis situations and finding resiliency during times of significant trauma. Becky shared the following thought with me, “Did you ever notice how shocked we are when we fail at something, as if perfection should be our assumed constant level of achievement? That belief makes us brittle, breakable, and more likely to fail. Recognizing temporary failure as a natural possibility on the continuum of success makes us flexible, resilient, and more likely to succeed. Ironic, isn’t it?

My friend Steve Hand coordinates all the Business Network International(BNI) chapters. When it comes to business networking, Steve is THE guru. When I asked Steve for feedback about his perspective on bouncing back from failure, he shared several quotes that he lives by and believes in:

“Anyone who has never made a mistake has never tried anything new.” ~ Albert Einstein
“Experience is simply the name we give our mistakes.” ~ Oscar Wilde
“Failure is a detour, not a dead-end street.” ~ Zig Ziglar
“I’d rather be a failure at something I love than a success at something I hate.” ~ George Burns
“One of the secrets of life is to make stepping stones out of stumbling blocks.” ~ Jack Penn
“Our greatest glory is not in never falling, but in rising every time we fall.” ~ Confucius
“Success does not consist in never making mistakes but in never making the same one a second time.”~ George Bernard Shaw

I cannot agree more with my friends in this article who have shared their thoughtful perspectives on how essential failure actually was to their success! I know this sounds odd because society has conditioned us into thinking that failure is BAD. However, failure is inevitable, especially to a leader who takes risk, and failure is simply part of life in many ways.

Unfortunately, I feel that many people never pursue their innermost desires and achieve their full potential because they are afraid of failure and are even more afraid of looking like a failure. Yet now we know that taking risk and even failing is a requirement for success in many ways!

Most people assume success only results from taking the correct actions and never making any mistakes. As this article points out though, we should be continually reminded we can learn just as much, if not more, from failure’s ‘teachable moments’ and picking ourselves back up one more time. What matters is not how many times we fall down, rather, it is how many times we pick ourselves up. In fact, I prefer the following quote even better: “It is not how many times we fall down that matters, it is how high we BOUNCE when we do fall down!”

Question: What would you do right now, if you knew you would not fail?
(Do not continue reading until you reflect on an answer to that question!)

What is keeping you from taking action towards this goal? Is it fear of failure in some way? Are you afraid of not being successful or afraid of not having enough, time, money, or support from someone else? Perhaps you are not comfortable with leaving your current comfort zone?

This fear has likely been keeping you in status quo, whether you have realized it or not.

Another question: Are you happy with where your life is right now? If I had a magic wand, would there be any changes you would like to make?

Likely, the answer is YES. Even for me, there are changes I want, need, and EXPECT to make both now and in 2013. For YOU, I think it is time for a new way of thinking – a positive change. I feel for you, without even knowing you, that it is time for you to ‘think differently’ about fear and failure like never before, and to start envisioning the success you will shortly have in your life because you are no longer afraid to take action.

You can accomplish anything you set your mind to yet YOU have to make the cognitive choice to get out of life what you expect from it. No one else is going to do that for you. And if fear of failure has been holding you back, one of the first steps you must take is to associate this fear of failure as a requirement for success! Even if you do make a mistake or fail in some capacity, associate this failure as an essential teachable element for living your dream and achieving goals. Simply learn as much as you can from that failure – you can never lose! Now that is an incredible feeling and it is possible to condition your thinking accordingly!

It will take effort to change this neuro-association and it most likely will not happen overnight. It will take time. But like a toddler learning to walk, you can, and need to, take baby steps to change this mental focus. And even if you fall down and feel like you cannot continue, you have to force yourself to try again and again – and even then again. An object in motion stays in motion; or the lack thereof.

Remember, it’s not how many times you fall, it is how many times you bounce back up even wiser. You simply just realized a way your approach would not work – and for that, be grateful.

To Your Current and Future Success!

Experts Share More: How To Bounce Back From Failure 2.0!

I received so much incredibly powerful content from recent interviews with local entrepreneurs that I wanted to offer a second ‘2.0’ version from the initial article titled ‘Experts Share: How to Bounce Back from Failure.

The individuals in this issue will not only share their perspective on ‘how’ they have attained success, but just as importantly, how they have successfully persisted through failure and setbacks. Whereas others may have given up when obstacles seemingly appeared too intimidating, these individuals learned to associate failure as an essential element of the success equation. By taking risk and learning from failure, they became extremely resilient and bounced back each and every time.

My friend Eric Gabriel is a leg amputee as a result from incredible wear on his knee during a tenure playing high-arc traveling softball. While making the grim decision to remove his leg was one of the most difficult choices of his life, the pain resulting from not doing so was even more unbearable. While others may have felt they would be losing a limb, Eric knew he would be gaining his life back – Eric’s story is so amazing that I asked him to be a contributing author in our Leading The Way group book series.

Eric is motivated and inspired by movies, and one particular movie is Rocky VI where the over-the-hill boxer Rocky Balboa (Sylvester Stallone) is talking to his son who cannot understand why his dad wants to return to the ring to fight once again. Rocky says to his son, “It ain’t about how hard you can hit. It’s about how hard you can get hit and keep moving forward – how much you can take and keep moving forward. That’s how winning is done son.”

Through wisdom from his personal setbacks and experiences, Eric shared with me that he would rephrase Rocky’s quote this way: “It’s not just how winning is done; it’s more importantly how living is done – life.”

Most of us are not prize fighters like Rocky and we are not Olympians. We all share the fact we have mountains and struggles to battle. Yet, it is because we can relate to adversity we can overcome it as well.

My friend Neal Anderson is a Southwestern Consulting executive and sales training guru who could write a book on persistence and finding that ring in the rubble opportunity. In fact, because he has such an amazing life story he is also a contributing author in our Leading The Way group book series.

Neal shares that “failure is when you really learn. Every time I heard a ‘no’ from a prospective customer, it developed my character and made me more interested in finding out why they did not say ‘yes.’ Success requires failure yet most people do not understand that success and achievement often lie just behind the next door.”

Neal continued explaining his philosophy on failure: “From my experience, the biggest reason people do not reach their goals is that they are afraid of rejection in some manner. They are afraid of failing in some way. Yet I’ve learned everything about who I am from the times I have failed – not when I have succeeded. Success is the accumulation of enough failures that you learn the lesson from!”

I was honored to get wisdom and feedback from Joe Clouatre, President/CEO of Innovative Business Partners, Inc. Joe has an incredibly proven track record of helping executives and companies excel through adversity. Joe shared, “It is not a case of whether a company will fail or struggle, it is a case of when a company will fail or struggle. Even the best companies go through challenging times. The important thing is to be able to recognize the early warning signs, or early failure signs, that always exist.”

Joe has an 8-step process for turning a company around that should itself be a best-selling book. His overall conclusion is that you should not wait until your company is struggling or in trouble to initiate the 8 steps – these 8 steps should be performed on a regular basis as part of running your business.

Joe is spot on. His business feedback relates to our lives as well. It is not whether we will have adversity in our life, it is when we ultimately will. Facing challenges is just part of our existence yet we can also learn so much from the ‘early warning’ signs to avoid failure. Do not be frustrated by the fact failure and challenges exist, be frustrated by not accepting setbacks to limit you and stop your success.

When we have the right attitude, we can learn from our mistakes and become more experienced individuals. As the Dalai Lama stated, “When you lose, don’t lose the lesson.”

Why though are these concepts so difficult to apply in our daily lives? Why do so many of us quit so often or get frustrated when things do not go our way? So many times we expect life to be easy, and when it is not we beat ourselves up – we are much too hard on ourselves.

One of the secrets to bouncing back from failure and actually using adversity to our advantage is that we must ask ourselves better questions to get the results we want. Meaning, when things do not go our way, instead of asking ‘What did we do wrong?’ we should ask ‘What can we learn from this experience?’

Moreover, when we are stopped short of our goal for some reason or when we fail, instead of asking ‘Why does this always happen to me?’, replace that negative question with ‘How does this experience make me a better person and a more educated individual?’

This belief system is about mental conditioning and it takes hard work to live with this philosophy. But believe me, when you apply and live with this approach to goals and dreams, the world and every experience you desire is at your fingertips.

You can never lose unless you give up.

You can always learn something, even when you do not get your way, but only when you ask yourself the right questions. Ask yourself a bad question, you will get a bad answer. Ask yourself a good question, you will get a good answer.

Resiliency and bouncing back from failure and setbacks is as simple as understanding and applying this philosophy and approach to life. Again, failure can never beat you when you ask yourself the right questions afterward.

Whether it is a bad experience at your job, a bad relationship, disappointing feedback you received, rejection and failure regarding something you have pursued, etc. – it does not matter. Even when bad, frustrating incidents occur, you still are a better, more educated and ‘seasoned’ individual as a result  – but only when you ask yourself the right questions.

To Your Continued Success!

-Kevin Snyder

The Gift of Laughter: Benefits from a Different Realm

Ideas of healing have spread throughout the ages and medicine has taken on all forms ranging from leaves to needles to pills and syrups. However, some things that are best for us are not always tangible.

As technology advances, the methods to healing are becoming more simple and organic causing true physicians to even emphasze the use of your own body to induce the natural and necessary process to healing. Parameters such as our senses (hearing, sight, taste, touch smell) are highly attributed to methods of alternative healing, sound in particular.

Finding out that laughter can create such a highly protective state within your body should make anyone want to crack a smile at least more than once a day! Children are found to laugh more than 400 times a day while adults may spurt a giggle at 15 times a day.
